It is the biggest misconception in Minnesota real estate: "The Sheriff's Sale already happened, so I lost my house." This is completely false. In Minnesota, homeowners are granted a Statutory Redemption Period—usually 6 months—after the auction. During this time, you still legally own the home, you can still live in it, and most importantly, you can still sell it to keep your equity. Here is how we stepped in at the 11th hour to save a St. Paul family from walking away empty-handed.
Our St. Paul client contacted us in a state of sheer panic. Their home had gone to a Sheriff's Sale almost five months prior. They had spent the last few months packing boxes, assuming that when the 6-month mark hit, the sheriff would show up to evict them.
They had completely given up on the idea of selling because they thought the bank already owned the property. With only weeks left until the redemption period expired in Ramsey County, they were about to forfeit tens of thousands of dollars in equity that rightfully belonged to them.
When a home is sold at a Sheriff's auction, the winning bidder (usually the bank) receives a Sheriff's Certificate. To save the home, that certificate must be paid off in full, plus interest and allowable fees. We immediately contacted the law firm holding the certificate to get exact, to-the-penny payoff figures before the deadline hit.
You cannot use a traditional retail buyer with a conventional mortgage when you only have two weeks left in a redemption period—banks move too slowly. We utilized our direct cash investor network to generate an immediate, As-Is cash offer that far exceeded the cost of the Sheriff's Certificate payoff.
We expedited the title work and rushed the closing. At the closing table, the cash funds were used to legally "redeem" the property, paying off the certificate holder entirely. The remaining funds were wired directly into the homeowner's bank account.
