Why Guidance Differs from Banks: The Role of an LLC

In recent times, certain banks in the United States have introduced what they term as Islamic mortgage contracts, aiming to attract Muslim clientele. This has prompted some prospective homebuyers to ponder whether opting for an Islamic mortgage through a bank presents a viable alternative.

However, the reality is quite the opposite — a U.S. bank remains a bank, and its offerings pose challenges for customers striving to adhere to Islamic principles.

Shariah law unequivocally prohibits the practice of riba, or the transaction of money with interest. The reliance on interest forms the cornerstone of a U.S. bank's business model, constituting their primary source of revenue. Banks typically transform cash deposits into debt instruments, further profiting from the sale of additional debt through credit cards or loans. Opting for home financing via a bank or one of its subsidiaries means supporting ventures that contravene Islamic teachings.

In stark contrast, Guidance is distinctly not a bank. The funds utilized to facilitate home purchases are acquired through halal means, aligning with Islamic principles. Moreover, U.S. banking regulations restrict banks from investing in and owning real property, rendering it unfeasible for them to adopt a co-ownership structure and establish an LLC similar to Guidance setup.

Recognized by the esteemed Assembly of Muslim Jurists of America (AMJA), Guidance Declining Balance Co-ownership Program has been endorsed as a permissible avenue for Muslim Americans seeking home financing. The program's contractual framework has been deemed sound and in harmony with Islamic tenets. In contrast, other entities affiliated with banks have been either deemed unsuitable for dealings by the Muslim public or permissible only under circumstances of dire need.

As a wholly-owned Muslim entity, Guidance operates as a financial services company, distinct from the traditional banking sector. It stands as the sole non-bank provider of riba-free financing approved by an independent Shariah board. This distinction offers reassurance to individuals seeking to purchase a home without compromising their religious values.
